Terms of Service

This is a plain-language draft covering how TheSet actually works today. It has not been reviewed by a lawyer — treat it as a starting point, not a finished legal document, and get it reviewed before relying on it.

1. What TheSet is

TheSet ("we," "us," "the Service") is a platform that lets live performers ("Artists") take song requests and tips from their audience during a show, at a page hosted at theset.live/{their-slug}. Artists create accounts; audience members ("Fans") use an Artist's page without needing an account of their own.

2. Accounts

You must provide accurate information when creating an Artist account and are responsible for activity under it. Keep your password and any overlay/capability tokens confidential — anyone with them can act as you on the Service.

4. Music licensing

TheSet is a request-and-tip tool, not a music licensing service. Artists are responsible for their own public-performance licensing (e.g. ASCAP/BMI/SESAC or venue-provided coverage) for any music they perform, exactly as if TheSet didn't exist. Song titles and artist names shown in the catalog are treated as facts, not licensed content.

5. Contributed content ("Binder" chord charts)

Chord charts contributed to the shared Binder are limited to chord progressions and structural facts about a song (never lyrics or tablature) and are shared across all Artists on the platform. By contributing a chart, you confirm it's your own transcription of publicly known chord facts and grant TheSet a license to host, display, and let other Artists use it within the Service.

6. Fan data and consent

An Artist's page may offer Fans the option to leave contact information ("Stay in touch"). Email and SMS opt-in are collected separately, and only the channels a Fan explicitly opted into are associated with their submission. Artists may use this list to reach their own audience; TheSet processes it on the Artist's behalf. See our Privacy Policy for details.

7. Acceptable use

Don't use the Service to: submit fraudulent payments or chargebacks; harass an Artist, a Fan, or TheSet staff; request or contribute sexually explicit, hateful, or illegal content; attempt to bypass rate limits, scrape the catalog at scale, or probe the Service for vulnerabilities without authorization; or impersonate another person or Artist.

8. Termination

We may suspend or terminate an account that violates these terms, including for payment fraud or abuse. You can close your Artist account at any time by contacting us.

9. Disclaimers

The Service is provided "as is." We don't guarantee it will be uninterrupted, error-free, or fit for a particular purpose. To the extent permitted by law, TheSet is not liable for indirect, incidental, or consequential damages arising from use of the Service, including lost tips or lost gig revenue from downtime.

10. Changes

We may update these terms as the Service changes. Material changes will be reflected here with an updated date; continued use after a change means you accept the update.
